AVIATION COUNSEL REVIEW REQUIRED

This page is draft wording prepared for review. Bracketed placeholders identify information Magnara must supply before publication.

Operational control

Private air transportation arranged through Magnara Club is performed by independent, appropriately authorized air carriers maintaining operational control of their respective flights. Magnara Club is not a direct or indirect air carrier and does not own or operate aircraft.

Carrier identification

The applicable operating carrier, and Magnara Club’s role in the arrangement, will be identified within the relevant quotation, agreement or confirmation where required by applicable regulation.

Aircraft information

Aircraft categories described on this website are educational descriptions of aircraft classes and do not represent Magnara inventory, specific aircraft, or availability. Specific aircraft, operators and terms are identified in writing per arrangement.

Broker role and required disclosures (United States)

Magnara Club acts as an air charter broker within the meaning of 14 CFR Part 295, arranging air transportation as agent of its client (the charterer). Magnara Club is not a direct air carrier, is not an indirect air carrier, and does not exercise operational control over any flight.

Consistent with Part 295, before a charter agreement is executed Magnara will disclose in writing: its capacity as agent of the charterer; the corporate name of the direct air carrier in operational control of the flight and the capacity in which that carrier is acting; the total cost of the air transportation and any fees imposed; and the existence of any relevant ownership or financial relationship between Magnara and the carrier. Any substitution of aircraft or carrier requires the client’s consent as provided in the applicable agreement.

Arrangements marketed outside the United States remain subject to the charter, agency and consumer rules of the applicable jurisdiction, and the corresponding disclosures are made in the relevant quotation or agreement.
